SUMMARY JUDGMENT DECISION REVERSED ON RENEWAL (Accident Location Disputed)
                                                                          
Following a transfer to PVRK to try damages after Summary Judgment was granted under Section 240(1) of the Labor Law, Jeffrey Van Etten obtained Reversal of the decision on a motion to Renew from the Hon. Justice Julia Rodriguez. Mr. Van argued that plaintiff was not, in fact, injured while working at the premises owned by the defendant, but had been injured at a separate building one block away (with the same numerical address, but a different street address). To secure the reversal, Mr. Van Etten got the plaintiff’s employer to provide supporting documentation on the location of where they worked, in addition to production of DOB records on the job permits and contracts of the employer (records not previously available as the there was no contract in effect with the employer and they were an out of state, non-cooperating party.
