SUMMARY JUDGMENT GRANTED ON BEHALF OF 4 MEDICAL PROFESSIONALS – Ariana Politis
Congratulations to Ariana Politis who successfully obtained summary judgment on behalf of 4 physicians by having claims of medical malpractice, wrongful death, loss of consortium, and lack of informed consent in an action brought by a decedent’s husband and infant child against her clients, three hospitalists and one intensivist. The case involved an alleged failure to timely and properly treat the decedent, a 28-year-old female who underwent Cesarean delivery of her baby and suffered complications therefrom, including significant blood loss due to a uterine artery bleed, which ultimately led to her brain death. Through the use of two Expert Affirmations in Internal Medicine and Critical Care Medicine, Ariana successfully argued that all four clients met the appropriate standards of care in their treatment of the decedent in both the Post-Anesthesia Care Unit and Intensive Care Unit and that none of the clients caused any injury to the decedent. The Court agreed and found that all four clients made out a prima facie showing of entitlement to summary judgment, demonstrating the absence of any issues of fact surrounding their treatment of the decedent, and granted the motion in its entirety. Kudos to Ariana for extracting these professionals from this extremely high exposure case venued in the Supreme Court, Orange County.
