DEFENSE VERDICT – Douglas Perry
Doug Perry obtained a defense verdict in a medical malpractice case in the Supreme Court,
Nassau County on January 23, 2025, in a case involving allegations of negligent total knee
replacement surgery resulting in 2 additional surgeries including salvage surgery upon the
Plaintiffs knee. The defense verdict was obtained on behalf of his client, a Board Certified
Orthopedist who specializes in joint replacement surgery and who rendered treatment to
the 68-year-old plaintiff. The case involved an alleged failure of our client to properly
perform knee replacement which the plaintiff claimed resulted in multiple subsequent surgeries
and permanent disability. The plaintiff’s expert, a board-certified orthopedist testified that the
negligent surgery by the defendant physician resulted in the need for 2 subsequent
surgeries; one of which was also alleged to have been negligently performed, and which left
the plaintiff disabled and in constant pain. During summations, the plaintiff’s counsel
requested that the jury award $850,000 for past pain and suffering and $1,750,000 for
future damages. After deliberating for a little more than 3 hours, the jury returned a
unanimous verdict in favor of our client. The trial took place before the Hon. Chris
McGrath in the Supreme Court, Nassau County over a period of six days. A great way to
start off 2025.
