PRE-ACTION PRESERVATION AND DISCOVERY FROM CITY OF NEW YORK – LARGE SCALE FIRE MATTER [REYES]

Michael C. Dombrowski and Jeffrey K. Van Etten successfully obtained, through an Order to Show Cause, pre-action preservation and discovery from the City of New York. The application relates to defending an ownership group in a largely publicized apartment building fire. Accomplishing such a ruling ensured that all necessary evidence was preserved and produced prior to mass litigation commencement, ensuring a complete and accurate investigation process for all involved. Among the items agreed to be produced were: instrumentality from the fire, FDNY and EMS photographs, audio and video; all related accident reports and protocols; prior and subsequent repairs, complaints, and/or violations documented with related City agencies; witness statements and their contact information; and security footage leading up to and through the incident.
