SUMMARY JUDGMENT GRANTED – PREMISES LIABILITY (Snow & Ice)

Summary Judgment granted in favor of the defendants, dismissing plaintiff’s Negligence claims in a premises liability case. Plaintiff slipped and fell on ice located on an exterior staircase on our clients’ premises. Both the codefendant, who was our clients’ tenant, and our clients moved for summary judgment under the Storm in Progress doctrine as plaintiff’s accident occurred within an hour after a light snow fall. And, despite the fact that there was a prior snowstorm days before, the Court found that the defendants did not have a reasonable amount of  time to clear the ice from the staircase and granted our client summary judgment.
