Defense Verdict for General Surgeon Following Four-Week Medical Malpractice Trial

On March 5, 2026, Doug Perry secured a complete defense verdict on behalf of a general surgeon following a four-week medical malpractice trial in Nassau County Supreme Court. The case arose from the implantation of a spinal cord stimulator to treat the plaintiff’s intractable pain and failed back syndrome. The plaintiff alleged that our client departed from accepted standards of surgical care by failing to properly assist in the placement and securing of the stimulator leads, resulting in the need for revision surgery within days of the initial procedure. The plaintiff also asserted separate claims that our client failed to obtain adequate informed consent for both the initial procedure and the subsequent revision surgery.

At trial, the plaintiff presented expert testimony in Pain Management and Informed Consent in support of the claims of negligence. The defense challenged the plaintiff’s allegations and expert opinions and demonstrated that our client’s care and involvement in the procedures were appropriate and consistent with accepted medical practice. Following four weeks of testimony and a day and a half of deliberations, the jury rejected the plaintiff’s claims and returned a verdict in favor of our client, resulting in a complete defense victory.
