Defense verdict in the Supreme Court- Doug Perry

On September 1, 2026, Doug Perry secured a defense verdict in the Supreme Court of the State of New York, Nassau County, on behalf of a board-certified radiologist accused of failing to properly interpret and report the findings of a CT scan of the abdomen and pelvis. Radiology cases always present a unique challenge; especially when you have well credentialed experts on each side testifying to completely diverse opinions as to the interpretation of the films in issue.

The plaintiff alleged that the radiologist’s interpretation delayed the diagnosis of a perforated gastric ulcer, resulting in peritonitis, sepsis, an extended hospitalization, and an open laparotomy. Although the plaintiff ultimately made a good recovery, she claimed that earlier intervention would have avoided the open procedure and the resulting abdominal scarring.

The defense established that the radiologist’s interpretation was appropriate and further demonstrated that decisions concerning the plaintiff’s admission and the need for a surgical consultation rested with the treating clinical team, regardless of the CT interpretation. After considering the evidence, the jury returned a verdict in favor of our client.
