Following a 6 week trial, wherein the Trial Court directed a verdict to a Union Electrician
under Labor Law Section 240(1), if the jury were to find that a door panel in the process
of being dismantled during Hurricane Sandy remediation fell from above 4 feet, Mr. Van
Etten secured a “hung jury” and mistrial after 6 days a deliberation when the jury (4-2
for the defense) could not decide if they believed plaintiff’s version of the facts. Post
mistrial declaration the case settled for one third of the amount demanded by plaintiff
at trial.
