Summary Judgement was granted dismissing co-defendant’s third-party claims against our client in action by plaintiff seeking recovery under Sections 240(1), 241(6) and 200 of the New York State Labor Law. Third-party Defendant demonstrated that the protections of the Labor Law were not applicable as the alleged accident did not involve a gravity-related risk. Third-Party Defendant further demonstrated that liability cannot be imposed under common law negligence due to lack of evidence of a dangerous condition at jobsite or defect in equipment used by plaintiff.
